1. Acceptance of Terms

By accessing and using Popcorn CMS ("Service"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to abide by these terms which are outlined below, please do not use this Service.

2. License to Use

Popcorn CMS grants you a limited, non-exclusive, non-transferable license to use the Service for the purpose of managing and publishing your content, subject to these Terms and our Acceptable Use Policy.

3. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring your use complies with all applicable laws
  • The legality and legitimacy of content you publish through the Service
  • Obtaining necessary rights to use third-party content

4. Prohibited Uses

You agree not to use the Service for:

  • Illegal, harmful, or malicious purposes
  • Violation of intellectual property rights
  • Harassment, abuse, or discrimination
  • Transmission of malware or harmful code
  • Attempting to gain unauthorized access to systems
  • Violating the rights of third parties
  • Spamming or sending unsolicited communications

5. Subscription Plans and Billing

Our Service is offered on a monthly subscription basis. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel your subscription.

You agree to provide accurate billing information and notify us of any changes to your payment method.

6. Cancellation and Refunds

All sales are final. We do not offer refunds for subscription charges.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will not be charged for subsequent billing cycles after cancellation.

No refunds will be issued for:

  • Partial months of service
  • Unused subscription time
  • Charges incurred before cancellation takes effect
  • Any usage or feature access prior to cancellation

7. Demo Period

The Demo plan is free and provides limited access to Popcorn CMS for 7 days. After 7 days, your demo account will expire and you must subscribe to a paid plan to continue using the Service.

8. Intellectual Property

The Service and all content, features, and functionality (including but not limited to software, code, and user interface) are owned by Popcorn CMS, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

You retain all rights to content you create and publish through the Service. By using the Service, you grant us permission to use your content solely for the purpose of delivering the Service.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POPCORN CMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Indemnification

You agree to indemnify and hold harmless Popcorn CMS, its officers, employees, and agents from any claims, damages, or costs (including reasonable attorney’s fees) arising from your violation of these Terms, your use of the Service, or your content.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you violate these Terms or engage in conduct that we believe violates the law or harms others.

13. Modifications to Terms

We may modify these Terms at any time. Continued use of the Service after modifications constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Popcorn CMS is located, without regard to its conflict of law principles.
