🚨 Refund Policy

ALL SALES ARE FINAL. POPCORN CMS DOES NOT OFFER REFUNDS.

Once you have been charged for a Popcorn CMS subscription, the charge is non-refundable, regardless of the reason, including:

  • Dissatisfaction with the Service
  • Accidental purchase or duplicate charges
  • Misunderstanding of features or capabilities
  • Change of mind or decision not to use the Service
  • Technical issues preventing use
  • Early cancellation

You are responsible for reviewing the Service features and pricing before subscribing. If you believe you have been charged in error, contact us immediately at stesmi+popcorn@gmail.com. We may investigate billing errors, but refunds are not guaranteed.

Service Availability and Uptime

While we strive to maintain high availability, Popcorn CMS does not guarantee uninterrupted service. Google Cloud maintains a 99.99% uptime SLA for most services, but this is not an absolute guarantee. We are not liable for:

  • Service interruptions due to maintenance or updates
  • Downtime caused by factors beyond our control
  • Loss of content or data due to service outages
  • Any damages resulting from service unavailability

We recommend maintaining regular backups of your content outside of Popcorn CMS.

Limitation of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM:

  • MERCHANTABILITY (fitness for selling or trading)
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
  • THAT THE SERVICE WILL BE ERROR-FREE OR SECURE
  • THAT DEFECTS WILL BE CORRECTED

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPCORN CMS SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY
  • COST OF SUBSTITUTE GOODS OR SERVICES
  • ANY OTHER DAMAGES BEYOND THE FEES PAID IN THE PRIOR 12 MONTHS

This applies even if we have been advised of the possibility of such damages.

User Content Responsibility

You are solely responsible for all content you create, upload, or publish through Popcorn CMS.

You represent and warrant that:

  • You own or have the right to use all content you upload
  • Your content does not infringe any third-party rights
  • Your content complies with all applicable laws
  • Your content does not violate our Acceptable Use Policy

Popcorn CMS is not responsible for the legality, accuracy, or quality of your content. We are not liable for claims arising from your content.

Third-Party Content and Services

Popcorn CMS may contain links to third-party websites and services. We are not responsible for:

  • The availability or accuracy of third-party content
  • The security or privacy practices of third parties
  • Any damages caused by third-party services

Your use of third-party services is at your own risk and is governed by their terms and policies.

No Liability for User Actions

Popcorn CMS is not liable for:

  • Loss or corruption of data due to user error
  • Unauthorized access due to compromised credentials
  • Any damages caused by your misuse of the Service
  • Disputes between users or third parties

Security Best Practices

To protect your account and data, we recommend:

  • Use a strong, unique password
  • Enable two-factor authentication if available
  • Do not share your login credentials
  • Regularly review account activity
  • Report suspicious activity immediately
  • Maintain regular backups of critical content

Failure to follow these practices increases your risk of unauthorized access.

Service Modifications

Popcorn CMS reserves the right to:

  • Change pricing with 30 days notice
  • Restrict access to the Service for abuse
  • Update or modify these disclaimers

Continued use of the Service after changes constitutes acceptance of the updated terms.

Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate our Terms of Service
  • Engage in illegal or harmful activity
  • Abuse the Service or other users
  • Fail to pay subscription fees
  • Fail to comply with our Acceptable Use Policy

Upon termination, your access to the Service ceases immediately. We will delete your data according to our Data Retention Policy.

Data Breach Notification

In the event of a confirmed data breach, security incident, or unauthorized access to your data, we will notify affected users as required by applicable law. Notification timelines vary by jurisdiction:

  • GDPR (EU): Without undue delay, no later than 72 hours
  • CCPA (California): Without unreasonable delay
  • Other jurisdictions: As required by local law

Notifications will include details about the breach, affected data, steps we are taking to address it, and recommended user actions (password reset, monitoring, etc.).

Indemnification

You agree to indemnify and hold harmless Popcorn CMS, its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from:

  • Your use of the Service
  • Your content or user actions
  • Your violation of these Terms or applicable laws
  • Your infringement of third-party rights

Severability

If any provision of these disclaimers is found to be unenforceable, the remaining provisions shall continue in full force and effect.
